The plaintiff in error, hereinafter called defendant, was convicted in the district court of Muskogee county of manslaughter in the first degree and was sentenced to serve a term of four years in the state penitentiary.
The record discloses a state of facts about as follows : The defendant is a colored man who lived in the town of Haskell. On the date charged he shot and killed Bill Guillory, also a colored man. At the time of the homicide, defendant and deceased were but slightly acquainted. They had a short time before this had an al tercation in a restaurant, deceased at the time being…
