Affirming.

The appellee, Dank Ball, was employed as a laborer by the Evans Chemical Works, which was engaged in the mining of barytes in Boyle County. The mine, in which he was working at the time he received the injuries complained of, was an open ditch about 25 feet wide at the top of the ground, about 12 feet wide at the bottom, and of a depth varying between 15 and 25 feet.
