This appeal requires a construction and application of section 466 and 2059a-10, Ky. Statutes, as Jto the appellee Hargis Bank & Trust Company, on the facts alleged in appellant’s petition and ' amended petition, and as to the appellee A. H. Hargis on the alleged and proven facts.
