The petitioners instituted this proceeding, pursuant to CPLR article 78, to compel respondent McKnight, as Town Justice of the Town of Brunswick, Rensselaer County, to *334provide them with a copy of the transcript and of all exhibits introduced at a preliminary hearing held in that court on March 18, 1980 in connection with a charge of murder in the second degree against the respondent Jeffrey Downey.
