People ex rel. Reynolds v. Common Council of Buffalo

This is an appeal by the above-named relators from an order made at a Special Term of this court, directing that a judgment entered upon a remittitur from the Court of Appeals in the above-entitled proceeding be so amended as to make the costs of the proceeding, which were awarded to the relators, payable to Daniel McIntosh, who was at one time the attorney of record in the proceeding for the testatrix of the relators.

The facts are substantially as follows : Daniel McIntosh, an attorney and counselor at law, at the request of one Amelia E. Reynolds, procured or assisted in inducing the legislature of this state to pass a special act authorizing the appointment of commissioners by this court to appraise certain damages claimed to have been sustained by her by reason of the opening of a public street in the city of Buffalo.
