' Cross-appeals from a judgment of the superior court for Spokane county, Poindexter, J., entered May 3, 1906, upon the verdict of a jury rendered in favor.of the plaintiffs, in an action upon injunction bonds.

This is a suit for damages based upon two injunction bonds. The bonds were executed by the defendant Fred B. Huffman and another, with defendant Fidelity & Deposit Company of Maryland as surety. The facts stated in the complaint are substantially as follows: On the 23d day of December, 1903, in an action then pending in the dis*186trict court of the first judicial district of the state of Idaho, wherein one George.W.
