Appeal from an order of the Supreme Court (Kavanagh, J.), entered September 8, 2003 in Ulster County, which denied defendant’s motion to set aside the separation agreement between the parties.
Defendant seeks to set aside a separation agreement executed by the parties in September 1997. The parties were married in 1976 and are the parents of three children, born in 1978, 1980 and 1991. The agreement provided that plaintiff would receive the parties’ home in the Town of Plattekill, Ulster County.
