Petitioner-Appellant Gareth Baran is an Australian citizen. On February 16, 2007, he filed a petition in the Southern District of Alabama seeking the return of his minor son pursuant to the Hague Convention on the Civil Aspects of International Child Abduction (the “Convention”) and its implementing legislation, the International Child Abduction Remedies Act of 1988 (“ICARA”), 42 U.S.C. § 11603(b).
