In a proceeding pursuant to CPLR article 78 to review a determination of the Planning Board of the Town of Brookhaven, dated June 1, 2009, which, after a hearing, approved a site plan submitted by 01 Blue Point, LLC, the petitioner appeals from a judgment of the Supreme Court, Suffolk County (Sweeney, J.), entered February 3, 2010, which, upon an order of the same court dated November 9, 2009, denied the petition and dismissed the proceeding.
*822Ordered that the judgment is affirmed, with one bill of costs.
