ORDER
RAKOFF, District Judge.
On December 28, 2001, the Honorable Gabriel Gore'nstein, United States Magistrate Judge issued a Report and Recommendation recommending that this Court deny the petitioner’s petition for a writ of habeas corpus under 28 U.S.C. § 2255 as time barred. After plaintiff filed objections thereto, the Court undertook de novo review of the underlying record and of the issues raised by petitioner therein.
