Appeal from circuit court, Hew York county. Action by Mary E. Gr. Shaw against Richard Webber for personal injuries. From a judgment entered on a verdict in favor of plaintiff, and from an order denying a motion for a new trial made on the minutes, defendant appeals.

This action was brought to recover damages for a personal injury caused, it is alleged, by the negligence of the defendant and his servants. The defendant is a butcher having a retail store at No. 212 East 120 street; and for eight or nine years before January 1, 1890, the plaintiff had been a customer of the defendant, at this shop, and on the date mentioned she entered the shop for the purpose of purchasing meat.
