Defendant Robert Gramaglia, a sergeant in the Greenburgh, New York police department, appeals from the denial of his motion for partial summary judgment based on qualified immunity from plaintiff Ginna Anne Noel Pane’s claim for unlawful detention without reasonable suspicion in violation of the Fourth Amendment and New York law. Pane responds that we lack jurisdiction over Gramaglia’s interlocutory appeal because its resolution turns on disputed issues of fact.
