COLEMAN, Justice.

The respondents appeal from an adverse final decree in suit for declaratory judgment.

In amended bill of complaint, complainant states that it seeks a declaration of rights arising out of a written offer of sale of land executed by respondents and the subsequent repudiation thereof by respondents after said offer was accepted by complainant and “then the subsequent condemnation of the property therein described by the complaint in the Probate Court of Winston County, Alabama.
