The action was brought by plaintiff, as administrator of the goods, chattels and credits of Sarah Porter, deceased, to recover damages for the death of plaintiff’s intestate alleged to have been caused by the negligence of defendant. The answer of the defendant was substantially a general denial, the defendant as a separate defense alleging that the injuries resulting in the death of plaintiff’s intestate were caused by her own carelessness and negligence and not because of any carelessness and negligence on the part of defendant.
