ORDER DENYING MOTIONS TO DISMISS AND MOTION TO STRIKE

This cause is before the Court on motions to dismiss and motion to strike filed by Defendants, Prison Health Services, Inc. (“PHS”) and Frank M. Smith (“Smith”) (Dkt. 11). Plaintiffs Complaint (Dkt. 1) and Amended Complaint (Dkt. 3) allege deprivation of Plaintiffs decedent’s civil rights brought pursuant to 42 U.S.C. § 1983, joined with supplemental state claims for breach of contract and negligence.
