Statement of the Case

Appellant was convicted by a jury of false imprisonment, battery with serious bodily injury and two counts of rape.

Prior to trial, appellant made a Penal Code section 995 motion to set aside the information as to the false imprisonment and battery counts on the ground that he had been deprived of the right to have the magistrate declare the crimes to be misdemeanors under Penal Code section 17, subdivision (b)(5). 1 These counts had not been included in the complaint filed in the municipal court and were added to the information by amendment…
