I. Background
In this action, plaintiff seeks to recover for advertisements it placed in telephone directory yellow pages, based on a contract with defendant and statements of account mailed to defendant. The complaint alleges that “plaintiff and defendant entered into written contracts signed by both parties to place defendant’s advertisements in the following editions of the yellow pages telephone books at the following rates.” (Complaint 5.)
