Error to LivingstonMiner, J. Quo warranto proceedings by John E. Bird, attorney general, on the relation of William Alexander, against Eugene T. McOlear to try the title to the office of drain commissioner. There was judgment for respondent, and relator brings error.

These are quo warranto proceedings instituted in the circuit court for Livingston county *46against Eugene T. McOlear to determine by what right he held and exercised the office of drain commissioner in and for said county. Relator claims title to this office by virtue of appointment made by the governor under Act No. 592, Local Acts 1905, passed by the legislature, ordered to take immediate effect June 1,1905, entitled, “An act to provide for the election of public officers within the county of Livingston.” This act repealed all acts and parts of acts inconsistent with its provisions.
