This matter comes before this Court on remand from the Pennsylvania Supreme Court which has ordered reconsideration of this Court’s decision in Hill v. Port Authority Transit System of Allegheny County, 125 Pa.Commonwealth Ct. 69, 557 A.2d 430 (1989), appeal granted, remanded, 524 Pa. 466, 573 A.2d 1026 (1990) (Hill I), in light of the Supreme Court’s recent decision in Marshall v.
