This appeal from a denial of attorney’s fees stems from an action brought by the Public Law Education Institute (PLEI) against the United States Department of Justice (DOJ or Justice Department) under the Freedom of Information Act (FOIA), 5 U.S.C. § 552 (1976). The action sought to compel the disclosure of certain documents with respect to Justice Department guidelines governing the prosecution of individuals who failed to register with the Selective Service.
