This Freedom of Information Act (FOIA) 1 case presents questions of the scope and applicability of FOIA. Exemption 7(C) 2 and Fed.R.Crim.P. 6(e), pertaining to grand jury secrecy, in conjunction with FOIA Exemption 3. 3 It also presents a question regarding the meaning of the requirement that a party “substantially prevail” as a prerequisite for an award of attorney fees under 5 U.S.C. § 552(a)(4)(E).
