Frederick Seifratb was charged, tried and convicted before a justice of the peace of Eranklin county for caitrying a pistol as a weapon. He appealed to the circuit court, where he was again tried by a jury, on plea of not guilty, convicted and fined $25.

He filed a motion for a new trial, which was overruled, and he took a bill of exceptions, and brought error.

It was assigned as ground for a new trial that the verdict was contrary to evidence. Th,e bill of exceptions sets out the testimony of a number of witnesses examined at the trial, but does not state in so many words, or words of…
