Defendant was indicted for robbery in the second degree and grand larceny in the third degree. He was acquitted on the robbery charge, found guilty of the count charging grand larceny in the third degree and sentenced to five years’ probation and a fine of $100. On January 4, 1976 Magda Calero, the complainant, entered the courtyard separating the buildings 731-751 East 161st Street, Bronx, with her small son.
