Presently before the Court in the captioned case are Defendants’ Motions for Summary Judgment. (Doc. nos. 47, 52.) Construing the facts in favor of Plaintiff, the non-moving party, as the Court must do at this stage, and upon consideration of the briefs submitted by counsel, oral argu ment on December 13, 2007, and the relevant law, Defendants’ motions are DENIED.
