Derrick R. Smith appeals the judgment of the Circuit Court of Lafayette County, after a jury trial, of his convictions on Count I of the indictment against him for first-degree robbery, § 569.020, 1 and on Count II for armed criminal action (ACA), § 571.015. He was convicted on a theory of accomplice liability for aiding and abetting James Scott in the robbery of Harold’s Supermarket (Harold’s), located in Lexington, Missouri, during which Scott “displayed or threatened the use of what appeared to be a deadly weapon,” to-wit, a gun.
