SUTTON, Justice.
This is a trespass to try title suit and the appeal comes from the District Court of Calhoun County.
The Guardian Loan & Trustee Company, Wm. C. Church and Ed J. Frazer sued John P. Forrest and five other defendants, to recover certain real property described in the petition and judgment situated in Calhoun County, Texas. A jury was impaneled to try the case but at the conclusion of all the testimony the Court took the case from the jury and rendered judgment for the plaintiffs for the lands sued for and costs.
