ELLIS, Chief Justice.

In this action brought under the Federal Employers’ Liability Act, the trial court awarded judgment for personal injuries sustained by the plaintiff, F. L. Denton, against his employer, The Atchison, Topeka and Santa Fe Railway Company. The court also granted the railway company judgment over and against Cities Service Oil Company, Third Party Defendant, for contribution under an indemnity agreement, for one-half of the total amount of the judgment awarded to the employee-appellee against the railway company.
