The plaintiffs in error, qualified voters and property tax payers in Childress county, suing for themselves and those similarly situated, by their application filed in the district court of Childress county, asked for a temporary injunction restraining the defendants in error, as members of the commissioners' court of Childress county, and as members of the state highway commission, respectively, and the chief engineer of said commission from diverting the proceeds of certain bonds issued and sold, from being used on a certain public road.
