This case has been the subject of most careful and elaborate consideration by the court. It has been briefed and argued with signal ability by counsel for both of the litigants. Judge BLAND and Judge ARNOLD have both written well considered opinions arriving however at different conclusions. On this account, because of the absence of Judge TRIMBLE, it was necessary that a special judge be called in.
