This was an action of assumpsit, brought by William H. Greene, against Morton C. Fisher, upon four promissory notes, which were payable to one Geo. D. Bayard, and by him indorsed to the plaintiff.

To the declaration the defendant pleaded the general issue, and a special plea denying the execution of the notes sued on. These pleas were sworn to and filed on the 4th day of June, 1877. On the 3d day of February, 1879, the defendant entered a motion for leave to file additional pleas, setting up the Statute of Limitations. The court overruled the motion, and this decision is assigned for error.
