On October 22, 1947, defendant executed and delivered to plaintiff his bond in the penal sum of $1,350.00 conditioned for the payment to plaintiff on Oct. 1, 1948, of the sum of $675.00 with interest and attorney’s fees. At the same time, to secure payment, he gave plaintiff a mortgage of real estate, a Chevrolet car, a Ford truck and a Ford skidder. Upon default plaintiff commenced two actions in claim and delivery in a magistrate’s court for the possession, respectively, of the Chevrolet car and the Ford truck, alleging the value of each to be less than $100.00.
