Mrs. Irene Bankston Maddox sued Indian Springs Swimming Pool Corporation and E. D. Hoard for damages for the death of her minor son, Donald A. Maddox, who died from injuries received from diving from a springboard into the pool operated by the defendants which had been partially drained so that the water beneath the springboard was only three or three and a half feet deep at the time the plaintiff’s son was injured.
