OPINION

EASLEY, Chief Justice.

Wilson sued for workmen’s compensation benefits. The trial court found in favor of Richardson Ford Sales, Inc. (Employer). Wilson appealed the case to the Court of Appeals, which affirmed. We granted certiorari and affirm in part and reverse in part.

The two issues raised are: (1) whether Employer’s voluntary payment of workmen’s compensation benefits and of medical expenses is, by itself, prima facie evidence that Wilson’s injury arose out of and in the course of his employment; and (2) whether injuries Wilson sustained while attempting to push Employer’s stalled…
