Mantz, J. —

C. S. Missildine and H. Pierce 'Witmer, plaintiffs, as owners under a deed from Polk County, Iowa, brought action of forcible entry and detainer in the municipal court of Des Moines, Iowa, against L. C. Brightman and Alice Bright-man, defendants, to recover possession of certain real estate in Des Moines. The action was docketed in equity. Defendants appeared, made written demand for a jury trial, and also filed motions for more specific statement and to dismiss, attacking the jurisdiction of the municipal court to try the case in equity.
