This action is on a life insurance policy, and the defendant appeals from a judgment thereon in favor of plaintiff.

The first question we will consider is, whether there was error in overruling defendant’s demurrer to the complaint, on the ground that it did not state facts sufficient to constitute a cause of action, in that it states no insurable interest in the life of the insured on the part of the original beneficiary, or of her assignee, the plaintiff.
