CHRISTIAN, Judge.

— The offense is negligent homicide; the punishment, confinement in jail for one year.

Omitting the formal parts, the indictment reads as follows:

“A. A. Snyder, Jr., did then and there unlawfully drive and operate an automobile, upon a public street within the limits of an incorporated City within this State, to-wit: — McCullough Avenue, within the limits of the City of San Antonio, Texas, while he, the said A. A. Snyder, Jr., was under the influence of intoxicating liquor, and he the said A. A. Snyder, Jr., .while so operating and driving said automobile aforesaid, did then…
