This is an interlocutory appeal from the refusal of the trial court to vacate a receivership. The proceedings involved in the appeal were as follows:

In a suit instituted in the District Court of Tarrant County by Clarence Jones, trustee in bankruptcy, against Mrs. Eliza B. Scott and Mrs. Ella C. Sheahan, both widows, on a promissory note for the principal sum of $11,000, executed by'defendants, and for foreclosure of a mechanic’s lien on a lot in the City of Fort Worth, for construction of a building with four apartments on the lot, Durward McDonald was appointed…
