Appeal from a judgment of the Supreme Court (Breslin, J.), rendered April 29, 2014 in Albany County, upon a verdict convicting defendant of the crime of criminal possession of a weapon in the second degree.

Defendant was charged with criminal possession of a weapon in the second degree based on allegations that he discarded a loaded firearm while being pursued by the police. Following a jury trial, he was convicted as charged and sentenced, as a second violent felony offender, to a prison term of 13V2 years, followed by five years of postrelease supervision.
