The defendant, Victor Anthony Properties, Inc. (Victor Properties or defendant), appeals from a final judgment in favor of the plaintiff, Plainfield Pike Development, LLC (Plainfield or plaintiff). The plaintiff had filed a declaratory-judgment action seeking adjudication regarding its use of a roadway over the defendant’s abutting property.
