MEMORANDUM & ORDER
DEVITT, Chief Judge.
This matter is before the court on defendant’s motion for an order enlarging the time within which he might appeal to the United States Court of Appeals for the Eighth Circuit from the entry of an order on October 19, 1971, denying his motion for a new trial.1
Defendant in support of this motion alleges that he had no knowledge of the entry of this order until after the 10 day period allowed by Rule 4(b) of the Federal Rules of Appellate Procedure for filing his notice of appeal had expired.
