On this application, pursuant to article 78 of the Civil Practice Act, to review a determination of the Board of Parole, the respondent moves to dismiss on the sole ground that the determination of the Board of Parole is not reviewable, in that it is a determination made in a criminal matter, within the meaning of section 1285 of the Civil Practice Act, which provides in part: “ Except as otherwise expressly prescribed *275by statute, the procedure under this article shall not be available to review a determination * * * 2.
