ORDER REJECTING THE PARTIES’ PLEA AGREEMENT

CORMAC J. CARNEY, District Judge.

On June 23, 2008, Defendant Henry Sa-mueli pleaded guilty to one count of making a false statement to the U.S. Securities and Exchange Commission (“SEC”) in violation of 18 U.S.C. § 1001. The plea agreement between Dr. Samueli and the United States Attorney’s Office (“USAO”) stipulates to a sentence of five years probation and a $250,000 fine, as well as a payment to the U.S. Treasury of $12 million.
