At a special court-martial composed of a military judge sitting alone, Appellant was convicted, contrary to his plea, of desertion in violation of Article 85, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 885 (2000). Appellant was sentenced to a bad-conduct discharge, confinement for 150 days, and reduction to pay grade E-l. The convening authority approved the sentence as adjudged.
