Plaintiff, Casualty Insurance Company (Casualty), brought a declaratory judgment action against defendant, E.W. Corrigan Construetion Company, Inc. (Corrigan), seeking a declaration that it had no duty to defend or indemnify Corrigan due to Corrigan’s failure to comply with the notice requirement of an insurance policy. Corrigan then filed a cross-motion for declaratory judgment and a motion for summary judgment. Casualty responded by filing a cross-motion for summary judgment.
