The following history of this case is necessary to an understanding of the propositions involved: The Broadway Investment Company, a corporation incorporated under the laws of the state of Washington, became indebted to the New England & Northwestern Investment Company on a note and mortgage. The mortgage was foreclosed and the mortgaged property sold, leaving a deficiency judgment. Under execution upon the deficiency, all the remaining property of the company was sold.
