The plaintiff in error filed a declaration in the Court below against the defendants in error, and caused a copy to be served as the commencement of suit, in the County *341of Wayne, in this State, by a deputy of the sheriff of such county on one Joseph Price, who was stated in the certificate of'service made by the officer to have been the Treasurer of the company.
