Lord, C. J.:

This is an action to recover real property. The complaint is in the usual form. The answer denies the material aver*299ments of the complaint, and alleges title and rightful possession in the defendant, and also improvements of the value of five hundred dollars. The reply denies the new matter set up in the answer. The cause being at issue, a trial was had which resulted in a judgment in favor of, the defendant for the possession of the land, from which an appeal has been taken to this court. •
