KELLAM, District Judge.

By order of September 25, 1990, and' pursuant to the provisions of 28 U.S.C. § 636(b)(1)(B), the motions for summary judgment filed by each of the parties were referred to The Honorable William T. Prince, United States Magistrate, to conduct such hearings as were necessary and submit to this Court proposed findings of fact and recommendations for disposition by a judge of this Court.
