This is an action to quiet the title to a tract of land and was begun by George J. Downer against John M. Schmidt, Florence D. Whitney, and others. Florence D. Whitney filed an answer and cross-petition alleging that she held the patent title to the land and asking that her title be established and quieted as against the plaintiff and her codefendants. The interest of Downer was acquired by W. H. Tuller and Mary I. Leaverton and they were substituted for him, and in answer to the cross-petition of Florence D. Whitney they alleged, inter…
