This is a tort claims action brought under the provisions of Neb. Rev. Stat. § 81-8,209 et seq. (Reissue 1994) in which the plaintiff-appellee and cross-appellant, Terry A. Talle, alleges she was damaged as the proximate result of the negligent placement of a minor boy in foster care with her by the defendant-appellant and cross-appellee, Nebraska Department of Social Services. The district court entered a partial summary judgment in favor of Talle on the issue of liability, and following trial thereafter awarded her the sum of $142,600 in damages.
